7. Information About Children

NXGen serves youth participants, including children as young as four years old.

We take the privacy and safety of children particularly seriously.

Parent or Guardian Registration

A parent or legal guardian must register a minor for participation in NXGen programs.

Children do not create their own NXGen website accounts.

We expect information regarding a minor to be provided by the child’s parent or legal guardian rather than directly by the child.

Children’s Information

Depending on the program or activity, NXGen may collect information about a child necessary to:

  • Register the child

  • Participate in racing and training

  • Provide coaching

  • Maintain safety

  • Respond to emergencies

  • Communicate with the parent or guardian

  • Administer scholarships or financial assistance

  • Manage team activities

  • Meet organizational, legal, insurance, or event requirements

We do not sell or rent children’s personal information.

We also do not intentionally use a child’s personal information for purposes unrelated to legitimate NXGen activities.

8. Parent & Guardian Rights Regarding Children’s Information

Parents and legal guardians may contact NXGen regarding personal information we maintain about their child.

Subject to applicable law and legitimate recordkeeping requirements, a parent or guardian may request:

  • Access to their child’s personal information

  • Correction of inaccurate information

  • Information about how their child’s information is being used

  • Deletion of information that NXGen no longer legitimately needs to retain

NXGen may need to verify the identity and authority of the person making a request before providing access to information or making changes.

We may retain certain information even after a deletion request when retention is reasonably necessary for:

  • Legal obligations

  • Tax or accounting requirements

  • Financial records

  • Safety records

  • Insurance requirements

  • Contractual obligations

  • Dispute resolution

  • Fraud prevention

  • Legitimate organizational recordkeeping

  • Other purposes permitted or required by law

Our general record-retention period is approximately three years, although certain records may need to be retained longer when required or reasonably necessary.

9. Photos, Video & Media

NXGen believes in celebrating our riders, families, volunteers, coaches, sponsors, and the motorsports community.

NXGen may photograph or record participants during practices, races, events, fundraisers, educational activities, community activities, and other NXGen-related activities.

  • Newsletters

  • Promotional materials

  • Fundraising materials

  • Sponsor presentations

  • Public relations

  • Event coverage

  • Educational materials

  • Recruitment and program promotion

  • Other NXGen communications

Because participants may be minors, NXGen uses a separate Parent/Guardian Media Release to address authorization for the use of photographs, video, and other media.

The applicable media release should be reviewed before participating in activities where media may be captured.

10. When We Share Information

NXGen does not sell or rent personal information.

We may share information when reasonably necessary to operate NXGen and provide services.

Information may be provided to individuals or organizations that have a legitimate reason to receive it, including:

We follow a need-to-know principle whenever reasonably practical: people receive the information necessary for them to perform their responsibilities rather than unrestricted access to all information held by NXGen.

For example, a coach may need certain rider information to perform coaching or safety responsibilities, while a volunteer helping with merchandise may only need information necessary to fulfill an order.

11. Sponsors & Partners

NXGen works with companies and organizations that support youth development, racing, education, accessibility, and the future of motorsports.

We may share limited information with sponsors or partners when appropriate to fulfill a sponsorship agreement, program requirement, event activity, recognition opportunity, or other legitimate organizational purpose.

NXGen does not sell participant, family, donor, customer, or website visitor information to sponsors.

Sponsors do not receive unrestricted access to NXGen’s participant database.

Any sharing of information involving children will be handled with particular care and consistent with applicable authorization, agreements, and law.

NXGen may communicate with individuals about:

  • Team activities

  • Race schedules

  • Scholarships

  • Volunteer opportunities

  • Sponsorship opportunities

  • Newsletters

  • Merchandise

  • Program announcements

  • Organizational news

Individuals may unsubscribe from marketing communications at any time by using the unsubscribe option provided in the communication or by contacting NXGen.

Unsubscribing from marketing communications does not necessarily stop important transactional, safety, registration, account, or program-related communications.

13. Donations

Donation information is used to process and administer donations, maintain appropriate financial records, communicate with donors, and support NXGen’s charitable activities.

NXGen does not sell or rent donor information.

Donors may contact NXGen to request changes to their communication preferences or to ask questions about information associated with their donations.

14. Scholarships & Financial Assistance

Information submitted through scholarship or financial-assistance applications may be sensitive.

  • Prevent misuse or fraud

Access to sensitive financial information should be limited to individuals who need the information to perform their authorized responsibilities.

15. Volunteers, Coaches, Mechanics & Team Personnel

Information collected from volunteers, coaches, mechanics, and other team personnel may be used to:

  • Evaluate applications

  • Communicate regarding responsibilities

  • Verify qualifications

  • Coordinate schedules

  • Conduct required screening or background checks

  • Maintain organizational records

  • Support safety and compliance

  • Administer volunteer and staff programs

Access will be limited based on the person’s responsibilities whenever reasonably practical.

16. Data Security

NXGen takes reasonable administrative, technical, and organizational measures to protect personal information from unauthorized access, disclosure, alteration, or destruction.

No website, database, electronic transmission, or storage system can be guaranteed to be completely secure.

For that reason, while we work to protect information, we cannot guarantee absolute security.

If NXGen becomes aware of a security incident involving personal information, we will respond in accordance with applicable law and our organizational procedures.

17. Data Retention

NXGen generally intends to retain personal information for approximately three years.

The actual retention period may vary depending on the type of information and the reason it was collected.

Certain information may need to be retained longer because of:

  • Legal requirements

  • Tax and accounting requirements

  • Insurance requirements

  • Contracts

  • Safety or incident records

  • Dispute resolution

  • Financial records

  • Grant requirements

  • Regulatory obligations

  • Legitimate organizational needs

When information is no longer reasonably necessary for a legitimate purpose, NXGen may securely delete, destroy, anonymize, or otherwise dispose of it.

Depending on your relationship with NXGen and applicable law, you may have choices regarding your personal information.

You may contact NXGen to:

  • Ask what personal information we maintain about you

  • Request correction of inaccurate information

  • Request access to your child’s information

  • Request correction of your child’s information

  • Request deletion of information that NXGen no longer legitimately needs

  • Change communication preferences

  • Unsubscribe from marketing communications

  • Ask questions about how information is used

Certain requests may be subject to verification or legal limitations.

20. State Privacy Rights

Privacy laws vary by state.

Depending on where you live and whether a particular law applies to NXGen or your circumstances, you may have additional privacy rights concerning your personal information.

These rights may include, where applicable:

  • The right to correct inaccurate information

  • The right to request deletion

  • The right to obtain a copy of certain information

  • The right to opt out of certain types of processing

  • The right to appeal certain privacy decisions

  • The right to exercise applicable privacy rights without unlawful discrimination

NXGen will evaluate privacy requests based on applicable law, the nature of the request, and the information involved.

Because privacy laws change and may contain exemptions or thresholds, this policy does not attempt to state that every privacy right applies to every visitor.

21. Nevada Privacy

NXGen is based in Nevada and may collect information from individuals located in Nevada and other states.

NXGen will handle personal information in accordance with applicable Nevada privacy requirements and other applicable laws.

Individuals with questions about their Nevada privacy rights may contact NXGen using the information provided in this policy.

22. Third-Party Websites & Social Media

The NXGen website may contain links to or integrations with third-party websites and platforms, including social media, sponsors, event organizations, payment providers, video platforms, and other services.

Once you leave the NXGen website or interact directly with a third-party service, that third party’s privacy policy may apply.

NXGen is not responsible for the privacy practices, security, content, or policies of independent third-party websites.

We encourage visitors to review the privacy policies of websites they visit.

23. Children’s Online Privacy

NXGen understands that privacy protections for children can involve additional legal requirements.

Because NXGen serves children, we seek to structure our registration and information-collection practices so that parents and legal guardians remain involved in the process.

Children do not create independent NXGen website accounts.

Parents or legal guardians are responsible for registering minors and providing information necessary for participation.

If you believe a child has provided personal information to NXGen without appropriate parental or guardian involvement, please contact us immediately so we can review the situation.

24. Accessibility & Privacy

NXGen is committed to making our programs, communications, and website accessible to families and participants.

If you need an alternative method to submit a privacy request or access information because of an accessibility need, please contact us.

We will make reasonable efforts to provide an appropriate alternative.

Changes may be made because of:
